Fortunoff's agrees to deliver prepaid orders

New York — Bankrupt retailer Fortunoff's, which began going-out-of-business sales in late February, has agreed to deliver prepaid orders of in-stock furniture.
New York Attorney General Andrew Cuomo said the decision, made after his office responded to numerous consumer complaints, reversed an earlier move to include that furniture in the liquidation sales.
Cuomo said Fortunoff's canceled delivery of such purchases on March 5 and told consumers that, although the furniture was in stock, it would not be delivered and no refunds would be provided.
"In these difficult economic times, many stores are unfortunately facing challenges, but so are individuals," Cuomo said in a statement released by his office. "It is critical that companies that are facing bankruptcy continue to meet their obligations to consumers to the fullest extent possible."
The attorney general said that partially paid orders and fully paid orders of furniture that is not in stock will not be filled, and said consumers who made payments with credit cards should dispute those charges as soon as possible.
Consumers who paid by cash or check should file a "proof of claim" with the bankruptcy court, Cuomo said.
