Regal Fabrics settles lawsuit

Middleton, Mass. — Regal Fabrics, a converter of upholstery fabric, has settled its copyright infringement litigation against another fabric producer, a furniture manufacturer and a retailer.
President Steve Kahan said a "substantial" cash settlement was paid to Regal to compensate the company for lost profits, but declined to reveal the amount.
The suit, filed in U.S. District Court in Boston, claimed that Regal's tapestry pattern No. R8133 was copied by fabric source Koba, then used in futons produced by Harbortown that were sold by retail chain Shopko, based in Green Bay, Wis.
"There were three parties involved in the sale and distribution of the fabric and the merchandise made from it, and our attorneys did a great job bringing them all to the table to be accountable for their actions," Kahan said. "It took over two years to resolve this matter through the courts, but it was a great result, as we successfully defended our rights, making the copiers pay for their actions."
