Judge dismisses Canadian Bedding conspiracy lawsuit

Store had charged Sleep Country, Western Sleep Products with collusion

VANCOUVER, British Columbia — A judge here has dismissed a lawsuit charging that the owners of the Sleep Country bedding chain had conspired with a mattress supplier to put a competitor out of business, the Vancouver Sun is reporting.

Canadian Bedding Co. Ltd. took legal action against Sleep Country and Western Sleep Products Ltd., a supplier of Serta mattresses, saying that Western had failed to supply Canadian Bedding with the latest line of Serta mattresses.

Canadian Bedding also claimed that Sleep Country conspired against Canadian Bedding to cause it to shut down its Serta-only stores. Canadian Bedding opened a number of outlets in 2005 under the name Serta Sit N Sleep, but the company went out of business in 2006, the newspaper said.

In dismissing the suit, the British Columbia Supreme Court judge also ordered Canadian Bedding to repay an inventory debt to Western and to pay the court costs of Western and Sleep Country.
