20 may escape antidumping review

Petitioners supporting the antidumping case on wood bedroom furniture have agreed to excuse 20 Chinese bedroom manufacturers from an administrative review of their 2006 bedroom shipments to the United States.

The petitioners' legal counsel, King & Spalding, sent a letter to Secretary of Commerce Carlos M. Gutierrez last week seeking the manufacturers' removal from the review. It sent that same letter, a copy of which was obtained by Furniture/Today, to a number of law firms representing furniture clients.

Factories the petitioners seek to remove from review include:

  • Art Heritage International Ltd., Super Art Furniture Co. Ltd., Artwork Metal and Plastic Co. Ltd., Jibson Inds. Ltd., Always Loyal International.

  • COE Ltd.

  • Dongguan Kingstone Furniture Co. Ltd., Kingstone Furniture Co. Ltd.

  • Guangzhou Maria Yee Furnishings Ltd., Pyla HK Ltd., Maria Yee Inc.

  • Hamilton & Spill Ltd.

  • Kunshan Lee Wood Product Co. Ltd.

  • Kunshan Summit Furniture Co. Ltd.

  • Leefu Wood (Dongguan) Co. Ltd., King Rich International Ltd.

  • Link Silver Ltd (V.I.B.) Forward Win Enterprises Co. Ltd., Dongguan Haoshun Furniture Ltd.

  • Nanhai Jiantai Woodwork Co. Ltd., Fortune Glory Industrial Ltd. (HK Ltd.).

  • Nathan International Ltd., Nathan Rattan Factory.

  • Shanghai Jian Pu Export & Import Co. Ltd.

  • Sheng Jing Wood Products (Beijing) Co. Ltd., Telstar Enterprises Ltd.

The 20 companies originally were part of a proposed annual Department of Commerce review of 196 Chinese bedroom manufacturers. The review will determine the amount of retroactive duties paid on wood bedroom product shipped to the United States by those producers in 2006.

The names of all 196 companies were published in a March 7 Federal Register announcement of the administrative review. Companies had 90 days from that date to have their names taken off the review list.

Because they were on the list of names submitted by petitioners supporting the antidumping case, those petitioners had to agree to drop them from the review. For the 20 companies that are excused from the review, the importers of record of products from those factories will lock into paying duties based on the rate in effect at the time of goods shipped in 2006.

In most cases, these companies were at the 6.65% rate, which rose to 7.24% in November 2006. Shingmark was assigned a rate of 4.96% at that time.

It was unclear whether other companies might be removed from the list during the 90-day period, which ends June 5. The May 8 letter from King & Spalding indicated the petitioners continue to desire a review of all other companies identified in their request for the initiation of the 2006 administrative review earlier this year.

Officials from King & Spalding and lead petitioner Vaughan-Bassett Furniture were not available by press time to comment on the list, or to say why they requested the 20 companies' names be removed.
