JCPenney gets green light to sell Martha-designed goods

New York - An appeals court here has turned down Macy's request to overturn a recent ruling that allows JCPenney to sell home merchandise designed by Martha Stewart Living Omnimedia under the JCP Everyday label.
According to reports from the Associated Press and Bloomberg, the ruling came down yesterday.
The original injunction covered bedding, bath and cookware - categories Macy's claims as exclusives under its contract with MSLO. Macy's lawsuit against MSLO continues in a separate court.
JCP has already begun selling the Stewart-designed goods on its web site. According to AP, some of the JCP Everyday product has also become available in stores.
