DeCoro sues Rooms To Go over design
Claims retailer knocked off products

HIGH POINT — Leather furniture producer DeCoro USA is suing retailer Rooms To Go for allegedly knocking off one of its designs.
According to documents filed this week in U.S. District Court in Greensboro, N.C., DeCoro claims that the giant retailer’s River Leather Collection is a copy of sofas, loveseats and chairs in DeCoro’s 2977 series, which it sold to Rooms To Go from about February 2006 to June 2007.
Jeff Seaman, CEO of Rooms To Go, declined to comment.
According to the filing, DeCoro claims Rooms To Go committed copyright infringement by selling designs that are “substantially identical, if not identical, in appearance and design” to DeCoro products. The suit claims that at one time, the retailer also displayed product tags indicating that the River pieces were a replacement for DeCoro’s 2977.
In addition, DeCoro alleges that Rooms To Go used unauthorized reproductions of copyrighted photographs.
DeCoro is asking the court to stop Rooms To Go from selling the designs and using the photographs and to award DeCoro profits and royalties for furniture sold. DeCoro also is seeking other unspecified damages and restitution.
