Alleges design infringement of two dozen items
Gary Evans -- Furniture Today, December 22, 2010
ROSEMEAD, Calif. —- Upper-end furniture manufacturer Marge Carson said it has filed a copyright infringement suite against Philipp Langdon Furniture, alleging the company knocked off several of its designs and design elements.
The suite, filed in Greensboro, N.C. federal court, charges Philippe Langdon copied from Marge Carson's Bordeaux, Les Marches, Pacifica, Palladian, Perugia, Segovia, Umbria and Vouvray collections. The suite said 24 designs were copied, including Philippe Langdon's Riviera, Islander, Versailles, Corbella and Kyle Vince collections.
Marge Carson, according to court documents, is seeking to have Philippe Langdon, based in Bell Gardens, Calif., cease all U.S. sales, manufacturing and importation of the infringing furniture and provide compensation in the form of attorney's fees and damages incurred from such sales.
"Marge Carson prides itself on elegant and original designs, created exclusively for us by some of our industry's top designers," said company president Will Sharp, noting the alleged knockoffs are among the company's best sellers. "We must aggressively protect our design integrity of our collections, and ensure our retailers that they will not be subjected to design knockoffs," he added.
