DOC rebuffs duty rate review for Chinese producer Marvin Furniture

WASHINGTON — The U.S. Department of Commerce has made a preliminary decision to deny Chinese case goods producer Marvin Furniture's request for a new shipper review.
That means that importers of record of wooden bedroom furniture from the plant would pay the China-wide duty of 216% on shipments made Jan. 1-June 30, 2011, unless a future review determines otherwise.
The company sought a review of its shipments for the period. The review would determine whether the company should receive a lower antidumping duty than the China-wide 216% rate typically assigned to manufacturers without a history of shipping wooden bedroom to the U.S. market.
In its analysis the DOC found that Marvin Furniture did not report shipments made prior to the review period in question. Based on that, it decided to preliminarily rescind the request for a review.
The duties, which have been in place dating back to June 2004, are the government's way of leveling the playing field for U.S. producers that have been injured due to unfairly priced imports.
Interested parties may comment on the Marvin Furniture decision within 30 days of the Jan. 10 publication of the announcement in the Federal Register. The DOC will make a final decision on the matter no later than 90 days after its preliminary decision.
