CARB extends sell-through dates for California retailers

SACRAMENTO, Calif. — California furniture retailers will again have more time to sell off existing inventories of product that doesn't comply with the state's stringent composite panel regulations.
The regulations, which began a phased-in implementation in 2009, involve formaldehyde emissions from composite panel, a commonly used product in wood furniture and upholstery frames.
The California Air Resources Board earlier this month issued an advisory extending the sell-through date for retailers of finished goods made with pre-Phase 1 panels to Dec. 31. Click here to read the advisory.
That applies to finished goods that are currently part of a retailer's California-based inventory that were purchased before Dec. 31, 2011, and for which the retailer has purchase documents.
The advisory also extended to Dec. 31, 2012, the sell-through date for non-importer distributors and fabricators of finished goods made with Phase 1 panels.
It also extended the sell-through date to Dec. 31, 2013, for retailers of finished goods containing Phase 1 panels.
The advisory also noted it is no longer legal for importers, distributors, fabricators, or retailers to purchase finished goods that contain pre-Phase 1 composite wood for sale in California.
The state has already issued several extensions of sell through periods. The deadlines allow businesses to sell existing inventories of furniture and other products manufactured before the more stringent Phase 2 standards began phasing in.
The advisory said the extension was due to slow sales existing inventory and because small businesses may still not yet be familiar with the regulation.
